Disputes have occurred quite often over a landlord entering a rental premises without warning. There are now laws in place that clearly outline the obligations that landlords have in this area. To be fair one must look at the situation from both sides of the argument. Firstly the investor has put a lot of money into the property and needs to keep it in repair and make sure tenants are looking after it during the lease. Keeping checks on smoke alarms and electric safety switches are not only important for the landlords investment but also for the safety of the tenants themselves.

These conditions also apply where the premises are handled by property management firm. If the landlord decides to sell the property, or re lease it knowing the tenants intend to leave, he cannot hold an open house inspection without the consent of the tenants. This consent must also be in writing, not verbal. Entry to the premises for this purpose, even with the agreement of the tenants, is clearly defined.


Sundays and public holidays are not allowed entry days, and for the rest it must take place between the hours of 8am and 6pm. The landlord and/or his agent must specify a two hour period in which the inspection is to take place, and must enter the premises within the two hour period. If entry has taken place in this time slot but the inspection isn't over by the end of the time period they may stay longer to finalize the inspection.

In the event a landlord believes the tenants are damaging his property, he must give notice of intent to enter, either with tradespeople for repairs, a property management professional or a police officer if needed. There does not have to be a two hour period stipulated for this situation. If repairs are required, twenty-four hours notice must be given to the tenant before he can enter to carry them out. Inspections and repairs are not the only reason landlords may need to gain entry to the premises. Smoke alarms may need to be checked or electrical safety switches installed or checked. On these occasions twenty-four hours notice is required.


Tenancy laws have been drawn up to allow the landlord reasonable access to his investment without causing undue loss of privacy for the tenant. If each party respects the rights of the other all will go well, but if the landlord oversteps his boundaries by not giving the appropriate notice before entry, the tenant has the right to file a complaint to the Rental Tenancies Authority.
